Our business consists of providing specially created courses and mentoring programs, through which we want to support people working in the IT field who want specialist guidance, courses, and programs that can be purchased by the requests made through the website https://www.codality.eu (hereinafter the Website).

Careful! Please note that the services you can access through our website provide you digital content, as defined in the O.U.G. (Emergency Ordinance Of The Government) no. 141/2021 and O.U.G. (Emergency Ordinance Of The Government) no. 34/2014, respectively - data produced and provided in digital format and therefore you will benefit from the right of withdrawal, as mentioned below.

Our website meets all the compliance conditions, agreeing with the requirements imposed by the O.U.G. (Emergency Ordinance Of The Government) no. 141/2021 on certain aspects related to contracts for the provision of digital content and digital services.

The website is created in such a way as to ensure compatibility with most internet browsers (Google Chrome, Safari, Mozilla Firefox, and Microsoft Edge). However, we cannot guarantee the compatibility of the Website with all computer equipment, systems, or programs used by you, especially if the latest updates of those systems/programs are not installed.

We also inform you that we cannot provide access to the content of our website in those countries where the population's access to multimedia content is restricted, limited or blocked by government acts or by specific legislation, and these restrictions/limitations also cover the content or tools media from the website.

The services offered are presented on the Booking page of our website, and for more information related to the available services, such as their content, price, etc. please check the description of each package presented on the site. We would like to inform you that we offer three types of packages, namely: a test package - free, a package that includes one session and a package of 4 sessions.

The package of 4 sessions, cannot be purchase directly from our website, but through the order form you will be able to join a waiting list, as a result of filling in the data requested and the answers provided to the questions addressed to you. Thus, after analyzing your request, we will contact you later, for payment and scheduling of sessions.

We indicate that we will consider your request valid and the distance contract will be considered concluded at the moment the order is placed and the payment for the chosen package is made, for packages that are not free. The payment of the services is made exclusively online by credit/debit card, and later you will receive by e-mail the tax invoice for the services.

The prices displayed on our website can be changed at any time, including through possible changes imposed by tax laws, but these changes will never have a retroactive effect.

You have the responsibility for keeping your personal information up-to-date and correct, necessary for the smooth development of the commercial relationship. All data entered by you as a customer are subject to our Privacy Policy, found on our website.

We allow placing the order on our website by any natural person, regardless of nationality, with a minimum age of 18 years at the time of placing the order. We do not allow access to persons under the age of 18, to complete the order form that allows access to the website's services. Any access to the website by minors directly or through legal guardians/representatives is done at their own risk.

To subscribe to the newsletter on our website, it is necessary to add your e-mail address in the "Stay updated" section, with the possibility of unsubscribing when you wish to do so.

To use the services on our website, it is necessary to fill out the order form.

The order consists of filling in your personal data, such as: name, surname, address, e-mail address, as well as viewing the availability for scheduling a meeting with our representatives, followed by choosing a date for the appointment, depending on the package you want. The choice of these packages will be made by selecting the desired package, communicating the email address to which tax invoices and other communications will be sent to you, as well as entering the billing data, phone number.

The purchase of packages through our website takes place within the limits of our availability, respectively for the packages and data, which you will find available on the website. To the extent that at a given moment we will no longer have available dates for the appointment, you will be able to register on the waiting list.

Also, if the availability in the calendar displayed on the website is not suitable for you, you can send us an email at adrian@codality.eu, stating what your availability would be, and we will analyze your request and come back with an answer.

Regarding the services provided, we will issue you a tax invoice, your obligation being to provide us with all the information necessary to issue the invoice, according to the legislation in force. In order to provide the courses through our website, it is necessary to complete the order form, which requires the communication of your data, name, surname, billing address and the communication of an e-mail address. You will then be redirected to the web page of the payment processor (https://stripe.com) in order to make the payment by means of a credit/debit card.

In addition, our page does not store your provided card data for payment, so all information provided regarding your card is processed exclusively by Stripe. For more details related to these aspects, please consult the Terms and Conditions offered by the Stripe processor at the following link: https://stripe.com/en-ro/privacy.

We also inform you that our company does not directly store your personal data that you make available to us through the order form, they are stored exclusively by the platforms used on our website, meaning which we point you to their pages, where you can read their personal data protection policy, namely:

By completing the order, you agree that all the data provided, necessary for the document generation process, are correct, complete and true on the date of placing the order. You also consent to CODALITY L.T.D. contacting you, by any available means, in any situation where it is necessary to contact you in connection with the order in question or with the development of the commercial relationship in general.

After completing the transaction, you will receive an electronic notification with the result of the electronic processing of the online payment and an electronic tax invoice corresponding to the payment, to the e-mail address indicated in the order form.

If the card used for payment cannot be charged due to insufficient funds, your order cannot be processed and you will be notified immediately.

If debiting an amount is not possible due to errors made through the secure payment processor, you will receive an email asking you to retry the payment. If you will not be able to make the payment in this way either, you will have the possibility to pay these amounts by means of a bank transfer, based on the issued invoice.

Careful! Depending on the payment processor chosen by CODALITY L.T.D. and the security criteria of your card issuers, there is a possibility that at the time of registration, you will be asked to pay the amount of 1 leu, in order to verify the validity of the provided bank card.

On the date of publication of these terms and conditions, all amounts are expressed and charged in RON currency, as well as in Dollar currency, for natural or legal persons from abroad, VAT value being displayed and added later, in the Stripe platform, depending on the country from which the payment is made. If CODALITY L.T.D. will use non-resident payment processors in Romania, there may be certain exchange rate differences, depending on the issuing bank of the card used by the customer.

In the case of online payments, CODALITY L.T.D. is not responsible for any other additional costs incurred by the user, such as currency conversion fees applied by the issuing bank of his card, in case the card issuing currency differs from RON. The customer will be solely responsible for these additional costs.

After the completion of the payment process, based on the information provided by the customer, within a maximum period of 60 minutes, you will receive by e-mail from the processor Stripe, a confirmation of the payment, as well as a confirmation from Calendly, of the date selected for online appointment scheduling. Also, before the actual meeting takes place, you will receive an email from Calendly, respectively a reminder about the date and time of the meeting. To protect our intellectual property right, we inform you that you have no right to copy, photograph, video record, the content of our courses or online meetings.

For exceptional situations that are beyond our control, in which the website appears non-functional for a short period of time (eg: problems with third-party hosting services or other technical problems), we will allocate the time and resources necessary to fix the problem in the shortest possible time. If you encounter problems of this kind, you can contact us at the e-mail address adrian@codality.eu and we will try to offer you all the support necessary to resolve the situation, as quickly as possible.

 

Right of withdrawal

The https://www.codality.eu platform represents a service site, existing on the site at the time you sign up, and according to art. 16 lit. a) from O.U.G. (Emergency Ordinance Of The Government) no. 34/2014, updated, service contracts are exempted from the right of withdrawal, after the complete provision of the services, if the execution has started with the express prior consent of the consumer and after he has confirmed that he has become aware of the fact that he will lose his right of withdrawal after the full execution of the contract by the professional.

Also, according to art. 16 lit. a) from O.U.G. (Emergency Ordinance Of The Government) no. 34/2014, updated, service contracts are exempted from the right of withdrawal, if: m) the provision of digital content that is not delivered on a physical medium, if the provision began with prior agreement expressly of the consumer and after he has confirmed that he has become aware of the fact that he will lose his right of withdrawal.

Therefore, in the case of packages that include a single session, we inform you that after making the payment, you do not benefit from the right of withdrawal from the contract concluded at a distance and you will not benefit from the reimbursement of the amounts paid.

In the case of packages that include 4 sessions, for mentoring services, purchased through the online platform, through which digital content is provided to you, you will not benefit from the right of withdrawal from the contract concluded at a distance and you will not benefit from the reimbursement of the amounts paid, except in part. Respectively, if withdrawal is desired, prior to the first meeting, you will lose the value of the first meeting, calculated as follows, the value of the package divided by 4, and if withdrawal is desired in the other cases, respectively at the second, third or fourth meeting, we will return the money to you in proportion to the remaining sessions, the amount being calculated according to the previous formula.

For honored orders, i.e. meetings carried out in full, we do not reimburse the value of the order, nor is it possible to convert it into a future credit (according to Directive (EU) 2019/2161 of the European Parliament and of the Council of November 27, 2019).

The reimbursement request for the situations previously exposed can be done by sending an e-mail to the address: adrian@codality.eu.

If you are not satisfied with our services, you can contact us at adrian@codality.eu, regarding the situation that requires you to request a refund and, even if digital products are exempt from the return of payment, under justified conditions, we will analyze the possibility of returning the value of the order.

The cancellation of the service order, which falls under the above conditions, leads to the reimbursement of the value of the order. The payment will be made by CODALITY L.T.D., to the customer within 30 days of receiving the cancellation notice.

 

Intellectual property rights

All copyrights, trademarks and any other intellectual property rights in all texts, images or other materials on this website are the property of CODALITY L.T.D. or of its affiliates/collaborators. No material on this site may be reproduced in part, in whole or modified without the express consent expressed by CODALITY L.T.D. or by the holder of this right.

All rights are reserved to CODALITY L.T.D. It is strictly forbidden to use this site for the purpose of destroying or altering it, its content or its security, or for discrediting or harassing CODALITY L.T.D. or its affiliates/collaborators. CODALITY L.T.D. will take all technical and organizational security measures to protect the data over which it has control, against any situation of accidental or intentional manipulation, loss, destruction or against access by an unauthorized person. Subscribe to the newsletter

On our website you have the opportunity to sign up for the newsletter. Through it we want to regularly inform our customers about our offers, articles that we write, as well as about any other information, in order to support you.

The newsletter can be received by you only if you provide us with a valid e-mail address and if you register to receive the newsletter. A confirmation e-mail will be sent to the e-mail address registered by you, in order to send the newsletter. The confirmation email is used to prove whether the customer is authorized to receive the newsletter. During the newsletter registration, we store the IP address of the computer system assigned by the Internet Service Provider (ISP) and used by the customer at the time of registration, as well as the date and time of registration.

The collection of this data is necessary in order to understand possible illegal uses of the customer's email address. The personal data collected by registering for the newsletter will only be used to send the newsletter. There will be no transfer of personal data collected by the newsletter service to third parties. The customer has the right to unsubscribe from the newsletter at any time. Also, the client's consent to store personal data in order to receive the newsletter can be revoked at any time, and in each newsletter you will find a link to unsubscribe.

 

Changes to terms and conditions

Changes to these terms and conditions that will appear along the way will be published on this web page without informing you. CODALITY L.T.D. reserves the right to revise and update these rules at any time without notice or prior acceptance of users.

 

Full agreement

These Terms and Conditions of Use, together with the Privacy Policy, contain the entire agreement between the parties concerning their subject matter and replace all prior agreements, arrangements, and understandings between the parties concerning their subject matter.

 

Major force

Neither party shall be liable for failure to perform its contractual obligations if such failure to perform on time and/or improperly, in whole or in part, is due to a force majeure event. Force majeure is the unforeseeable event beyond the control of the parties and which cannot be avoided (this includes, but is not limited to, changes in laws or regulations, fires, strikes, epidemics, wars).

If, within 15 (fifteen) days from the date of its occurrence, the respective event does not cease, each party will have the right to notify the other party of the full termination of the contract without any of them being able to claim other damages to the other.

Dispute Resolution. Law and Jurisdiction

The customer acknowledges that these terms and conditions are governed by Romanian law. In case of any conflicts between CODALITY L.T.D. and the customer, an amicable solution will be attempted first.

If an amicable solution will not be possible, the conflict will be resolved by the competent court at the registered office of the provider CODALITY L.T.D., having as its object claims arising from or regarding any use of our services.

Considering the provisions of Regulation (EU) no. 524/2013 regarding the online resolution of disputes in the field of consumption and amending Regulation (EC) no. 2006/2004 and Directive 2009/22/EC, CODALITY L.T.D. offers the consumer the opportunity to opt for out-of-court settlement of any disputes, by using the European online dispute resolution platform (SOL platform), a digital tool created by the European Commission to facilitate independent, impartial, transparent, effective, fast and fair resolution, extrajudicially, of disputes concerning the contractual obligations resulting from contracts for the sale or provision of online services between a consumer who resides in the Union and a trader established in the Union. In this sense, the following link to the SOL platform can be used.

If any provision of this agreement or the application of any such provision to any person or set of circumstances shall be determined to be invalid, illegal, void, or unenforceable to any extent, the other provisions of this agreement shall not be prejudiced or affected and will continue to be valid and enforceable to the fullest extent permitted by law.
